1About these terms

These terms are an agreement between you and Ugital Digital Marketing (SSM registration no. To be confirmed) (“Ugital”, “we”) for the use of talent.ugital.com.my (the “platform”). By creating an account or using the platform, you agree to these terms, our Privacy Notice, our Cancellation & Refund Policy and our Service Delivery Policy.

2Accounts

  • You must be at least 18 years old to create an account.
  • One email address can be used for one type of account only: merchant, creator or admin.
  • Keep your sign-in codes private. You are responsible for what happens under your account.
  • The details you give us, including follower numbers and business details, must be true and up to date.

3How the platform works

  • A merchant publishes a campaign and chooses one or more creator pools (platform and content language).
  • Creators apply. On the 3rd working day after publishing (or the next working day for urgent campaigns), the applicant list opens and 1 credit is used per pool.
  • The merchant picks creators, confirms them and pays the creator fees and service fee shown on the invoice.
  • Creators deliver the content described in the campaign brief. After the merchant approves the content, Ugital pays the creator.

4Credits and payment

Credits are sold in packages. The price in Malaysian Ringgit (RM) and the validity period are shown before you buy. Credits cannot be transferred, exchanged for cash or used after they expire.

You can pay online through our payment gateway or by bank transfer. Creator fees are paid in full when you confirm creators. We issue an invoice for every payment.

5Merchant responsibilities

  • Describe the campaign, reward and deliverables accurately, and honour them.
  • Only promote products and services that are lawful in Malaysia.
  • Do not hire creators you met on the platform outside the platform to avoid fees for 12 months after their application.

6Creator responsibilities

  • Only apply with social media accounts you own, and keep your follower numbers honest.
  • Deliver the agreed content by the agreed date, and follow the brief.
  • Disclose paid or sponsored partnerships as required by each social media platform.
  • Your content must be your own and must not break any law or anyone else’s rights.

7Content rights

Creators keep the copyright in their content. The merchant may share and repost the approved content on its own channels for 12 months, crediting the creator. Any other use needs the creator’s agreement.

8What is not allowed

Fake followers or engagement, false information, fraud, harassment, unlawful content, collecting other users’ data, or interfering with the platform. We may suspend or close accounts that break these terms.

9Limitation of liability

Ugital provides the platform to connect merchants and creators. We do not guarantee the results of a campaign, such as views, followers or sales. To the extent the law allows, our total liability for any claim is limited to the amount you paid to Ugital in the 3 months before the claim. Nothing in these terms limits rights that cannot be limited by law.

10Cancellation and refunds

See our Cancellation & Refund Policy.

11Changes to these terms

We may update these terms. The latest version is always on this page with its date at the top. We will email you about important changes. If you keep using the platform after a change, you accept the updated terms.

12Governing law and disputes

These terms are governed by the laws of Malaysia.

If you have a dispute with us, please contact us first at To be confirmed. Both sides will try in good faith to settle it within 30 days. If it is not settled, the dispute will be decided by the courts of Malaysia, in Kuala Lumpur.

These terms are available in English, Bahasa Melayu and Chinese. If the versions differ, the English version prevails.
